FreshFleet Technologies is committed to protecting your personal information under the Data Privacy Act of 2012 (RA 10173) and all regulations of the National Privacy Commission (NPC) of the Philippines.
2. Personal Information We Collect
(a) Identity: full name, date of birth, government ID (Riders only); (b) Contact: phone, email, address; (c) Transaction: order history, payment records, service preferences; (d) Technical: IP address, browser, device, cookies, app usage; (e) Location: pickup/delivery addresses, real-time GPS (Riders only, during active deliveries); (f) Communications: in-app messages, support tickets, ratings.
3. How We Use Your Information
To process and fulfill orders; verify rider identity; process payments via PayMongo; send order status notifications; improve platform performance; comply with legal obligations; prevent fraud; send marketing communications (consent-based, opt-out available anytime).
4. Legal Basis for Processing
Under RA 10173: (a) Contract performance — order fulfillment; (b) Legitimate interests — fraud prevention and security; (c) Legal compliance — Philippine law requirements; (d) Consent — marketing and optional data collection.
5. Data Sharing
We share your data only with: Partner Shops (name, order details, address for order fulfillment); Riders (name, contact, address for pickup and delivery); PayMongo (payment processing per their own privacy policy); Google Analytics 4 and Meta Pixel (anonymized usage data); Philippine government authorities (when legally required). We do not sell personal information to third parties.
6. Data Retention
Account data retained while active and for 1 year after closure. Transaction records retained for 5 years per Philippine tax and commercial law. Rider ID documents retained 3 years after rider relationship ends. Non-legally required data deleted upon verified request.
7. Your Rights Under RA 10173
You have the right to: be informed of how your data is used; access your personal data; correct inaccurate data; request erasure of data no longer necessary or processed unlawfully; object to processing for direct marketing; data portability in a structured, commonly used format; lodge a complaint with the NPC at www.privacy.gov.ph. To exercise any right, contact contact@freshfleet.ph. We respond within 15 business days.
8. Cookies and Tracking
We use cookies to maintain session and preferences, analyze traffic via Google Analytics 4, and serve ads via Meta Pixel retargeting. Control cookie preferences through your browser settings. Disabling cookies may affect platform functionality.
9. Data Security
We implement: SSL/TLS encryption for all data in transit; access controls limiting data to authorized personnel; regular security audits. In the event of a personal data breach posing real risk of harm, we notify affected users and the NPC within 72 hours per NPC Circular 16-03.
10. Children's Privacy
FreshFleet is not intended for users under 18. We do not knowingly collect data from minors and will delete such data immediately upon discovery.
11. Changes to This Policy
Material changes notified via email or in-app notification. Continued use after the effective date constitutes acceptance.
